PUBLIC SERVICE AGREEMENT (OFFER)
For Paragliding Training Services
This document constitutes an official proposal (public offer) by an individual entrepreneur / organization, hereinafter referred to as the “Provider”, to enter into an agreement for the provision of paragliding training services with any legally competent individual over the age of 18, hereinafter referred to as the “Client”.
The agreement is concluded by accepting (agreeing to) the terms of this offer, in accordance with Article 633 of the Civil Code of the Republic of Turkey.
Acceptance of this offer is equivalent to signing a written agreement. Acceptance is considered completed upon payment for the course or confirmation of booking via the website https://oludeniz-paragliding.com/paragliding-training.
1. Subject of the Agreement
1.1. The Provider undertakes to deliver paragliding training services to the Client in the scope, form, and according to the program described on the website.
1.2. The Client agrees to pay the full course fee and comply with all participation conditions.
2. Terms of Service
2.1. Training takes place in the Ölüdeniz region, Turkey, on specially designated training areas.
2.2. The course may include both theoretical and practical lessons, including ground handling, slope training, and supervised flights.
2.3. In case of non-flyable weather (rain, strong winds, storms, or other adverse meteorological conditions), the Provider reserves the right to postpone the practical part of the training to other days. Cancellation/postponement due to weather conditions does not constitute grounds for a refund.
2.4. Rescheduling may occur within previously agreed dates or in coordination with the Client.
2.5. The Client must follow all safety instructions. The Provider has the right to exclude the Client from participation without refund in case of violation of safety rules, inappropriate behavior, or being under the influence of alcohol or drugs.
3. Payment and Refund Policy
3.1. The course fee is listed on the website and may vary depending on the level, season, and other factors.
3.2. Full payment must be made before the start of the training.
3.3. Paragliding training is a non-refundable service. In case of cancellation initiated by the Client (for any reason including illness, injury, or personal matters), no refund will be issued.
3.4. Refund exceptions may be made solely at the discretion of the Provider on a case-by-case basis.
3.5. If the Client withdraws from the course after it has started, no full or partial refund will be provided.
3.6. If the course ends early due to weather conditions, the remaining sessions will be rescheduled, but no monetary compensation will be provided.
4. Responsibilities of the Parties
4.1. The Provider agrees to conduct the training in accordance with the approved program and safety standards.
4.2. The Client is solely responsible for the accuracy of the information provided and for their physical and mental fitness to participate.
4.3. The Provider is not liable for failure to provide services due to the Client’s fault (lateness, refusal to participate, illness, etc.).
4.4. The Client acknowledges and accepts that paragliding is an extreme sport that involves risks.
4.5. The Provider recommends that the Client have accident insurance.
5. Force Majeure
5.1. The parties are released from liability for partial or complete non-fulfillment of obligations caused by force majeure circumstances such as natural disasters, epidemics, war, government restrictions, or other unpredictable events.
5.2. In the event of such circumstances, the deadline for fulfilling obligations is extended for the duration of their effect.
6. Personal Data Protection
6.1. The Client consents to the processing of personal data necessary for the performance of this agreement.
6.2. Personal data will not be shared with third parties, except in cases required by Turkish law and/or necessary for the execution of this agreement (e.g., with insurance companies, transfer service providers).
7. Final Provisions
7.1. This agreement is governed by the laws of the Republic of Turkey.
7.2. Any disputes or disagreements shall be resolved through negotiation, and if that fails — in court at the Provider’s registered location.
7.3. The Provider has the right to amend this offer without prior notice by publishing a new version on the website.
